These Terms and Services (“Terms”) govern your access to and use of the MisBiz Pro website, services, software solutions, automation systems, marketing services, fulfillment services, digital products, and related offerings provided by MisBiz Pro (“Company,” “we,” “our,” or “us”).

3. Eligibility

4. Client Responsibilities

You agree to:

5. Payments

All fees are due according to the invoice, proposal, subscription terms, or checkout terms presented at the time of purchase.

Unless otherwise stated in writing:

  • deposits and setup fees are non-refundable
  • recurring services bill on the agreed schedule
  • late payments may pause work or suspend access to deliverables
  • you are responsible for any third-party platform, software, ad spend, domain, hosting, or processing fees unless expressly included

MisBiz Pro reserves the right to change pricing at any time for future services or renewals.

6. No Guarantee of Results

We do not guarantee any specific financial result, lead volume, conversion rate, sales result, advertising performance, search ranking, or business outcome.

Marketing, automation, software, and business growth results depend on many factors outside our control, including your offer, market conditions, budget, audience, sales process, follow-up, and implementation.

Any case studies, examples, or testimonials are illustrative only and do not guarantee similar results.

7. Refund Policy

Because many of our services involve strategy, consulting, setup work, digital delivery, or custom implementation, all sales are final unless otherwise stated in writing.

If a service includes a separate written refund policy, that policy will control for that specific offer.

8. Intellectual Property

All content, systems, frameworks, templates, graphics, copy, videos, documents, branding, processes, and materials created by MisBiz Pro remain the property of MisBiz Pro unless otherwise agreed in writing.

Upon full payment, the client receives a limited license to use the final deliverables for the client’s own business purposes. You may not resell, redistribute, sublicense, copy, or commercially exploit our proprietary materials without written permission.

9. Client Content

You retain ownership of content and materials you provide to us. By submitting content to MisBiz Pro, you grant us a non-exclusive license to use, reproduce, modify, and display that content solely for the purpose of providing the requested services.

You represent that you have all rights necessary to provide such materials.

10. Third-Party Platforms and Tools

MisBiz Pro may work with or recommend third-party software, payment processors, advertising platforms, hosting providers, automation tools, or affiliate platforms. We are not responsible for outages, policy changes, account suspensions, billing issues, security failures, or functionality changes caused by third-party providers. PartnerStack itself distinguishes between platform terms and separate agreements that brands maintain with partners, which is why a clear external Terms page matters.

11. Affiliate and Partner Relationships

MisBiz Pro may participate in affiliate, referral, reseller, or partner programs. Any compensation disclosures, commission arrangements, promotional requirements, or partner-specific terms may be provided separately where applicable.

We reserve the right to accept, reject, suspend, or terminate any partnership, promotion, or affiliate relationship at our discretion.

12. Acceptable Use

You agree not to:

  • use our website or services for unlawful, fraudulent, deceptive, or harmful purposes
  • interfere with the operation or security of our systems
  • copy or exploit our materials without permission
  • submit false information
  • misuse our website, forms, automations, or digital tools

13. Termination

Our total liability for any claim related to our services or these Terms shall not exceed the amount paid by you to MisBiz Pro for the specific service giving rise to the claim in the 30 days preceding the event.

15. Indemnification

You agree to defend, indemnify, and hold harmless MisBiz Pro and its owners, contractors, affiliates, and representatives from and against any claims, losses, damages, liabilities, costs, and expenses arising out of:

  • your use of our services
  • your breach of these Terms
  • your content, materials, or business activities
  • your violation of any law or third-party rights

16. Disclaimer

All services, content, templates, digital products, and resources are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

17. Privacy

Your use of our services may also be subject to our Privacy Policy, if published separately. If you collect, upload, or process customer data through systems we build for you, you are responsible for complying with applicable privacy, notice, consent, and data protection laws.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Hawaii, without regard to conflict of law principles.
